The 13th Chamber of the Council of State held that the Public Procurement Board may not decide, without obtaining an expert opinion, on matters requiring particular technical expertise such as the assessment of demonstrations and samples. In a tender for biochemistry laboratory services held by a provincial health directorate, an appeal was lodged on the ground that the demonstration process had not been conducted in accordance with the legislation and with scientific criteria.
