In a tender by open procedure, may samples be assessed on a date before the date of the tender?

In the supply tender announced as to be conducted by open procedure on 12 July 2006, the contracting authority provided that tenderers' qualification would be assessed by the tender commission on the basis of samples required to be delivered three days before the date of the tender.
