Creation of Rights Other Than Ownership (Law No. 2886)

A right in rem is a right that confers direct and absolute power over a thing and that may be asserted against everyone. Under State Procurement Law No. 2886, the creation of rights other than ownership takes the form of leasing public immovable property or transferring the right of use to third parties by tender. In that case the contracting authority continues to hold the right of ownership over the property, while transferring by contract, as a result of the tender, a right of use for a fixed period and on conditions.
