Grounds for Cancelling a Tender

There are various grounds for cancelling a tender: cancellations falling within the discretion of the contracting authority holding the tender, grounds arising from the legislation on which the authority is obliged to cancel, and force majeure. Cancellations within the authority's discretion must be supported by concrete grounds set out in due form and must comply with the fundamental principles of Law No. 4734. Otherwise, where tenderers apply to the Public Procurement Authority or the court, the cancellation of the tender is itself annulled.
