Immovable Property Under the Authority and Disposal of the State

Immovable property under the authority and disposal of the State consists of places that cannot be the subject of private ownership, that fall directly within the sovereign power of the State and that are allocated to the public benefit. Over such property the State disposes not as an owner under the provisions of private law, but by superior powers based on public authority. Under Turkish law, ownerless places and property whose benefit belongs to the public fall within this scope. Such property may therefore not be the subject of private law transactions such as sale and purchase.
