Irregularity Through the Incorrect Determination of the Tender Procedure

Irregularity through the incorrect determination of the tender procedure is the restriction of competition, the steering of the tender process or the conferring of an advantage on particular tenderers by choosing a different procedure, most often the negotiated procedure or a procedure without notice, instead of the procedure that should be applied for the work subject to the tender, although the conditions laid down in the Law have not arisen. They generally take the form of applying the negotiated procedure where an open tender should be held.
