Proceedings for a Debt Following the Unjustified Termination of a Public Procurement Contract

Public procurement contracts are terminated on grounds such as the death, bankruptcy, serious illness, detention or conviction of the contractor, termination by the contractor, termination by the contracting authority, prohibited acts or conduct occurring before the contract, or force majeure. Where the contractor is found to have engaged in the prohibited acts and conduct listed in Article 25 of Law No. 4735, fault on its part may be established. Where a contract is terminated without just cause outside those situations, proceedings may be brought before the civil courts.
