Property of the Tenderer
In public tenders, the machinery, plant, equipment, vehicles or similar technical assets that the tenderer declares it will use in performing the work subject to the tender and that are in its ownership, or acquired by lease and actually in its use. The concept is significant in particular where the tender documents require particular machinery or equipment to be the property of the tenderer as a qualification criterion. Under the procurement legislation, contracting authorities may as a rule not require machinery, plant, vehicles and equipment to be the property of the tenderer.
