Reservation of Rights

A reservation of rights was a declaration showing that the contractor did not accept the content of a progress payment, book, record or document as it stood when signing it, and reserved its right to object. Following annulment decisions of the Council of State, however, the Public Procurement Board decided by its regulatory decisions of 16 August 2023 that the provisions on reservations of rights in respect of interim progress payments in Article 39(4)(e) of the General Specifications for Works and Article 42(a) of the General Specifications for Service Works were annulled.
