Stay of Execution

Where there is a risk of irreparable loss arising for the parties concerned if an act carried out by the administration is implemented, or where the administrative act is manifestly unlawful, the Council of State or the administrative courts order a stay of execution of that act. As a rule, security must be provided for a stay of execution to be ordered, although a stay may also be ordered without security where the circumstances so require. The decisions given are implemented without delay.
