Complaints and appeals made through lawyers must now be lodged electronically
For tenders after 15 April 2023, complaints to contracting authorities and appeals to the Public Procurement Authority had already been made subject to a requirement to be lodged through EKAP using an electronic signature.

The Public Procurement Authority has published an announcement on the mandatory use of electronic performance bonds
Before the contract is concluded, a performance bond of 6 per cent calculated on the contract price is taken from the successful tenderer.

The Public Procurement Authority has published an announcement on uploading to EKAP the documents to be submitted in tenders
According to the announcement, from 17 March 2024 documents that can be obtained or verified by querying EKAP or the websites of other public bodies and professional organisations having the character of a public institution.

The Public Procurement Authority has announced the entry into force of the Communiqué on procurement by direct procurement
The Communiqué on procurement by direct procurement, setting out the procedures and principles for conducting electronically the procurement provided for in Article 22 of Law No 4734, was published in the Official Gazette of 11 July 2023, No 32245.

The Public Procurement Authority has published an announcement on submitting electronic performance bonds through Takasbank
In order to ensure that the undertaking is performed in accordance with the contract and the tender documents, a performance bond of 6 per cent calculated on the contract price is taken from the successful tenderer before the contract is concluded.

Presidential Decision published on the principles governing additional price adjustment and extension of time
The provision headed “Grant of additional price adjustment and extension of time in construction works” entered into force on 28 December 2023 as provisional Article 7 of Public Procurement Contracts Law No 4735. The principles governing additional price adjustment and extension of time were set out in Presidential Decision No 8090 of 16 January.

The amendments on the refund of contract stamp duty and the removal of the exemptions for international tenders have entered into force
Stamp duty on the contract has been added to the provision in Stamp Duty Law No 488 on the refund of stamp duty on award decisions in tenders under Law No 4734. Accordingly, where a complaint is made to bodies within the scope of Public Procurement Law No 4734 or an appeal is lodged with the Public Procurement Authority.

The provision on additional price adjustment has been enacted
Law No 7491 amending certain laws and decree-laws was published in the Official Gazette of 28 December 2023 and entered into force. The provision headed “Grant of additional price adjustment and extension of time in construction works” was added to Public Procurement Contracts Law No 4735 as a provisional article.

A legislative proposal on additional price adjustment has been tabled
The provision in Article 40 of legislative proposal No 2/1812 amending certain laws and decree-laws was adopted at the meeting of the Grand National Assembly Plan and Budget Committee on 29 November 2023.

The Public Procurement Authority has published an announcement on guarantees provided in cash
Under Article 34 of Law No 4734, Turkish currency in circulation, that is to say cash, may also be provided as a guarantee in tenders. Following developments by the Authority, cash guarantee details declared in the qualification information table can be queried through EKAP.

Following the amendment to the procurement legislation, complaints and appeals must now be lodged through EKAP, and the rules on notices have changed
Amendments were made to the Regulation and Communiqué on Applications concerning Tenders, the Framework Agreement Tenders Implementation Regulation and the Public Procurement General Communiqué by the Official Gazette of 1 April 2023, No 32150.

Electronic tendering made mandatory
Amendments were made by the Regulation amending the Electronic Procurement Implementation Regulation published in the Official Gazette of 18 May 2022, No 31839.
