The Public Procurement Authority announcement on the Implementation Regulation on the Electronic Conduct of Public Procurement, which enters into force on 1 August 2025, has been published. The announcement introduces significant changes to the procurement system.

Tenderers must complete their social security activation
The Public Procurement Authority announcement on tenderers completing their Social Security Institution activation (the application for a certificate of no debt) has been published. Under it, the Implementation Regulation on the Electronic Conduct of Public Procurement, published in the Official Gazette of 18 May 2024, No 32550, enters into force on 1 August 2025.

The Constitutional Court has annulled the provision that the Authority's share, collected from the contractor at a rate of five per ten thousand of the contract price, “shall not be refunded in any circumstances”
Article 53 of Law No 4734, headed “Public Procurement Authority”, provides in subparagraph (j) that the Authority's revenues include amounts collected from contracts concluded in respect of tenders held under the Law where the price exceeds a stated threshold.

What do the changes to EKAP registration introduce, and how will EKAP users sign in?
According to the announcement, the developments relating to the changes in EKAP registration applications by domestic natural and legal persons will go live on 11 June 2025, and registration will operate through the central registry system, the tradesmen and craftsmen information system and the revenue administration.

Important amendments have been made to the determination of the work experience amount for construction works carried out in return for floor space or land
The Construction Works Tenders Implementation Regulation was amended by the Official Gazette of 10 December 2024, No 32748, following the annulment by the 13th Chamber of the Council of State, by its judgment of 28 February 2024 (case No 2018/2912, decision No 2024/1007), of a provision of that Regulation.

Important amendments have been made on price adjustment in service procurement
Amendments concerning the price adjustment rules to be applied in service procurement were made to sub-article 81.2 of Article 81 of the Public Procurement General Communiqué by the Official Gazette of 10 December 2024, No 32748.

An important announcement has been made on the registration of domestic natural and legal persons with EKAP
Turkish citizens who are natural persons and legal persons established under Turkish law who wish to take part in tenders must register with EKAP. How that registration is carried out is set out in the Electronic Procurement Implementation Regulation.

Amendments to Public Procurement Law No 4734 published; the scope of exempt procurement has been widened
Public Procurement Law No 4734 was amended by the Official Gazette of 26 July 2024, No 32613. Under those amendments, Article 3(1)(m) of the Law now covers all natural gas purchases to be made by the petroleum pipeline corporation.

Amendments to the procurement legislation made on 18 May 2024
By the Official Gazette of 18 May 2024, No 32550, amendments were made to the procurement regulations, the inspection and acceptance regulations, the Regulation and Communiqué on Applications concerning Tenders and the Public Procurement General Communiqué, and to the Implementation Regulation on the Electronic Conduct of Public Procurement.

What does the provision on the use of inflation-adjusted balance sheets in tenders introduce?
In tenders held under Public Procurement Law No 4734 in which balance sheets and equivalent documents are required as part of the documents relating to economic and financial standing, the Public Procurement Board addressed the doubts that had arisen as to which information and documents candidates and tenderers are to submit.
